Before booking a tour with Osaka Day Tours (the “Tour Service”), please read this waiver of liability carefully, as it waives your right to seek damages from the Tour Service and Kevin Riley (the “Owner”) in the event of any injury or loss experienced by you (the “Customer”) or any member of your group in association with a Tour Service tour.
By booking a tour with the Tour Service, you agree to be bound by this Waiver of Liability (the “Waiver”).
If you disagree with, and don’t accept, any part of this Waiver, please do not book a tour with the Tour Service.
1. Definitions
“Tour Service” means Osaka Day Tours and the service provided by it.
“Owner” means Kevin Riley, the owner of the Tour Service.
“Customer” means anyone booking and participating in a tour offered by the Tour Service.
“Waiver” means the entire contents of this document.
2. City Tours & Potential Risks
Although Osaka, and Japan in general, is a very safe environment, and your guide takes all precautions to ensure your comfort and safety on a tour, there still exists a potential risk of injury or loss associated with, but not limited to, traffic accidents, train travel, falls, collisions, or other incidents.
3. Hiking & Countryside Walking Tours & Potential Risks
Most countryside walks and hikes follow well-maintained trails in safe areas, however, there is always some level of risk of injury or loss due to rough or slippery terrain, sudden and unexpected changes in weather conditions, wildlife encounters, or other incidents that may occur during a tour.
Your guide is an experienced outdoorsman with wilderness survival and high-level first aid training. Please follow your guide’s instructions to ensure safety at all times.
4. Medical Attention & Insurance
In the event of injury or sickness occurring during a tour, your tour guide will ensure your transportation to the nearest clinic or hospital for treatment. The Tour Service and the Owner shall not be held liable for any expenses incurred due to any treatment provided by a clinic or hospital.
As with any travel in a foreign country, it is advisable to purchase travel insurance that covers medical expenses in the case of a medical emergency.
5. Waiver of Liability
By booking a tour with the Tour service, you agree that the Tour Service and the Owner shall not be held liable for any claims, costs, or expenses arising from any injury or loss experienced during a tour.
